hi all,

first time posting in this informative forum!!
really a good read Very Happy

ok, now for the question!
how do we determine for sure whether an apartment is residential or commercial titled?
let say the apartment have a shopping podium below and upper floors are apartments?
the S&P are as per Schedule H (Housing Developent Act).

it is safe to say that bcoz the S&P are per Schedule H, then it's residential titled?

(i) S&P may follow Schedule H even if it is a commercial title. Does not say much.

(ii) Residential + Shop mix may still be on a residential land whereby only the shops are approved for commercial use. This does not say much too.

(iii) It is pretty obvious whether an apartment is residential or commercial.
(a) Ask the relevant parties.
(b) Notice that all residentail must come with developer's license and advertising permit (the small prints at the end of the adverts)
(c) Do a land search, which is simply ridiculous. Fact is, a developer simply can't (and has no reason to) lie on its land use Razz

on the S&P, the has all the Housing Development Act, Licensing Control wordings on the very first page! Guess it is a residential titled land!
Yeah, the developer has developer permit and advertising permit for the project!
