Pls help - bought a property which the land had legal issue

HI

Recently i bought a house from a developer. i just found out the land had legal issue without our notice

Question:
1) can the developer sell the house which the land had legal issue?? they sell the house to us after the land involve in high court case which they didn't inform us in the first place. high court case can delay until many years

2) can i claim the 10% downpayment back from the developer and cancel the purchase because they hide us the fact of land legal issue in the first place??
if they reject to pay us back, what can i do and how?? pls advice.
Any action can i take against them??

Pls advice and pls help - i had paid 36k for the downpayment.

What is the legal issue? I cant advise without the necessary info. Sorry
