Is it true that the stamp duty will be reduced by half beginning next year?
That has quite an impact! Rite?
If yes means it is better to wait till next year to sign S&P for property, right? Stamp duty only take effective when S&P is signed or after signing the agreement with property agent?

| I bought a property recently and my lawyer told me that it started this year right after the announcement of budget 2008. This only entitle for properties under RM 250K. |

I just got the stamp duty bill from LHDN is no discount 50% for my rm235k property. The lawyer told me will effective on Jan 2008.
But after i called to LHDN officer clarify that alrdy effective on Sept 2007.
I really confusing on this and do need help from you guys. |

My loan for RM230K apartment has just been approved last week. Property is Master Title.
Am I eligible for 50% Stamp Duty discount or not? (I'm 1st house buyer)
What if the lawyer said, not gazetted yet?

Yes, u are eligible. It is true the discount is not gazetted yet, but your lawyer can write to LHDN asking for the 50% disc. and trust me they will approve it.
I just bought a house recently and my lawyer sent them the letter and succeed.
Wait for 1 week and ask ur lawyer to follow up with LHDN part. |

I bought my 1st house and signed the S&P in 1998. As the developer was PKNS, where it was a norm for them to take ages to get the MOT done, my MOT will only be executed this month.
Do I entitled for the 50% discount for MOT stamp duty?
My lawyer said that the discount is based on the S&P agreement date and since my S&P was signed well before the Sept 2007 effective date, I am not entitled for the 50%. |

the exemption has been gazetted vide
Stamp Duty (Remission) (No.3) Order 2007 - P.U. (A) 402
Condition to be eligible for exemption:
Residential Property less than RM250,000
SPA or instrument of transfer signed between 8 Sep 2007 to 21 Dec 2010
first property bought by one person (one person can claim once in his life time only)
To get the exemption, you need to sign a Statutory Declaration provided by the Stamp Duty Department _________________

i wonder where can i get a copy of this circular? I went to our bar council website but failed to find it

if you buy from dev, no stamp duty is payable yet...cause the title isnt out...
the discount is strictly for stamp duty on transfer for prop below 250k. even if its 250001, you would not be entitled...
stamp duty on loan isnt stamp duty on transfer...so you have to pay full stamp duty for the facility _________________ ..cheefsphotojournal.blogspot.com |
